DSI Forecast API Terms

These DSI Forecast API Terms (“API Terms”) govern your access to and use of the Dermidia developer API, related documentation, sample responses, and provisioning materials (collectively, the “API Services”) provided by Dermalapps LLC (“Dermalapps,” “we,” “us,” or “our”).

By requesting, activating, or using API credentials, you agree to these API Terms, our Privacy Policy, and any applicable order form, beta invitation, or pricing schedule we provide to you. If a signed order form conflicts with these API Terms, the signed order form controls.


1. Access and Eligibility

The API Services are intended for business and research users. You represent that you have authority to bind the company or organization on whose behalf you are requesting access. We may approve, deny, limit, or revoke API access at our discretion.

During private beta, the API Services may be incomplete, changed without notice, or discontinued. Beta access may be time-limited and may include unpublished rate limits or other operational constraints.


2. API Credentials

  • You must keep API keys and other credentials confidential and use reasonable security measures to prevent unauthorized access.
  • You are responsible for all activity conducted using your credentials.
  • You must notify us promptly at support@dermidia.com if you believe a key has been exposed, misused, or compromised.
  • We may rotate, suspend, or replace credentials if necessary for security, maintenance, or abuse prevention.

3. Permitted Use

Subject to these API Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the API Services for your internal business purposes and approved downstream campaign, analytics, or research workflows.

You may not:

  • Share, sublicense, sell, or provide raw API access to third parties without our written permission.
  • Use the API Services to build a competing dataset or service that substantially replicates the API Services.
  • Attempt to bypass rate limits, authentication controls, or other protective measures.
  • Use the API Services in violation of law, privacy rights, advertising rules, or platform policies applicable to your business.
  • Misrepresent the source, meaning, or certainty of DSI data or represent the API Services as medical advice or diagnostic output.

4. Data, Documentation, and Attribution

As between you and Dermalapps, Dermalapps retains all rights, title, and interest in the API Services, the DSI methodology, documentation, sample payloads, and any improvements to them. The API responses are licensed, not sold.

Some outputs may rely on third-party weather or climate sources. If we require source attribution or pass through additional usage restrictions for specific datasets, we will communicate those requirements in the documentation, provisioning materials, or your order form.


5. Commercial Terms

Private beta access may be free, invite-only, or limited to a trial period. Paid access, if offered, will be governed by the pricing, usage entitlements, billing cadence, and any overage terms presented in your order form, provisioning email, or checkout flow.

Unless we expressly agree otherwise in writing, the API Services do not include a service level agreement, dedicated support obligations, or uptime commitment.


6. Availability and Changes

We may modify endpoints, payloads, features, documentation, rate limits, or access policies at any time. Where practical, we will try to provide advance notice of material breaking changes, but beta and security-driven changes may occur immediately.


7. Disclaimers

The API Services are provided “as is” and “as available”. DSI data, forecasts, and market signals are informational estimates derived from environmental modeling and third-party data inputs. They are not medical advice, diagnosis, treatment, or guarantees of campaign performance.

To the fullest extent permitted by law, Dermalapps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.


8. Limitation of Liability

To the fullest extent permitted by law, Dermalapps will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunity arising out of or related to the API Services.

Our aggregate liability arising out of or relating to the API Services will not exceed the greater of (a) the amount you paid us for the API Services during the 12 months preceding the claim or (b) $100 USD.


9. Suspension and Termination

We may suspend or terminate your API access immediately if we reasonably believe your use creates a security risk, violates these API Terms, exceeds authorized usage, or exposes us or others to legal or operational harm.

You may stop using the API Services at any time. Upon termination, you must stop using revoked credentials and comply with any post-termination instructions we provide regarding retained data, cached responses, or attribution.


10. Governing Law

Unless a signed agreement states otherwise, these API Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Before filing a claim, each party agrees to attempt informal resolution by contacting the other party and allowing 30 days for discussion.
