Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Dermidia websites, dashboards, and applications operated by Dermalapps LLC (“Dermalapps,” “we,” “us,” or “our”), including dermidia.com, sense.dermidia.com, and related web or mobile experiences (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Developer API access is governed separately by our DSI Forecast API Terms and any applicable order form or subscription agreement. If those API-specific terms conflict with these Terms, the API-specific terms control for API use.

We reserve the right to update these Terms at any time. Continued use after the effective date of a revision constitutes acceptance. We will provide reasonable notice of material changes.


1. Eligibility

The Services are intended for users aged 17 and older and are directed at residents of the United States. By using the Services you represent that you meet these criteria. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Description of Services

Dermidia provides informational tools related to indoor environmental conditions and skin health, including:

  • Dermidia Seasonal and Select — tools that calculate and display the Dry Skin Index (DSI) for your location based on weather data, historical climate records, and standard indoor heating assumptions.
  • Dermidia Sense — a sensor dashboard that displays real-time and historical indoor environmental data (temperature, humidity, and derived DSI) from a provisioned sensor device (DSIsense or Shelly) registered to your account.
  • Learn and informational content — editorial articles about the science of indoor skin health.
  • Developer products — including the DSI Forecast API, which is offered under separate API-specific terms.

We may modify, suspend, or discontinue any feature of the Services at any time with reasonable notice where practicable.


3. Accounts and Authentication

Certain Services — including Dermidia Sense — require an account. Account registration and authentication are managed through Amazon Cognito. You are responsible for:

  • Maintaining the confidentiality of your credentials.
  • All activity that occurs under your account.
  • Notifying us promptly at support@dermidia.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or pose a security risk.


4. Sensor Devices and Connectivity

Dermidia Sense integrates with connected sensor devices provisioned through the Dermidia mobile application. By connecting a device you acknowledge:

  • You are responsible for the proper installation, maintenance, and network connectivity of your device.
  • Sensor readings reflect the conditions at the device placement location and are influenced by local factors such as proximity to heat sources, windows, and HVAC vents.
  • Connectivity interruptions may result in gaps in sensor data. We are not liable for missed readings or data loss arising from device or network failures.
  • Device data is transmitted to our cloud infrastructure approximately every 15 minutes when the device is online.

Your sensor data is governed by our Privacy Policy, including the provisions on sensor data retention and our anonymous research program.


5. Paid Services and Beta Programs

Certain features of the Services may be invite-only, beta, or paid. Where a paid subscription or purchase is offered, the material commercial terms will be presented to you before you complete checkout or sign an order form.

  • Features, pricing, usage limits, and availability may change during beta.
  • Payment processing, if enabled, may be handled by a third-party processor. We do not store full payment card numbers on our servers.
  • Billing cadence, renewal terms, cancellation procedures, and any refund policy will be disclosed at the time of purchase or in a separate agreement.
  • Developer API subscriptions are governed by the DSI Forecast API Terms and any order form or provisioning email we send you.

We may change pricing or packaging prospectively. Any existing subscriber commitments will be handled in accordance with the commercial terms presented at signup or in a separate written agreement.


6. Informational Purpose Only — Not Medical Advice

Important health notice

All content provided through the Services — including DSI values, skincare guidance, ingredient recommendations, and editorial articles — is for general informational purposes only. It is not medical advice, diagnosis, or treatment. Nothing in the Services creates a professional relationship between Dermalapps and any user.

If you have a skin condition, allergy, or other medical concern, consult a licensed dermatologist or qualified healthcare provider before making changes to your skincare routine. The DSI is an environmental measurement tool, not a clinical diagnostic instrument. Individual skin responses to environmental conditions vary based on genetics, health status, medications, and other factors outside the scope of the Services.


7. Intellectual Property

All content, software, design, graphics, and the Dry Skin Index calculation methodology are the proprietary property of Dermalapps LLC or its licensors and are protected by applicable intellectual property laws.

  • You may access and use the Services for personal, non-commercial purposes.
  • You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Services without our prior written consent.
  • You may not attempt to reverse-engineer, decompile, or extract the DSI calculation algorithms embedded in our server-side infrastructure.
  • You may not use our trademarks, service marks, or brand assets without our prior written permission.

Feedback or suggestions you submit to us may be used by Dermalapps without restriction or compensation.


8. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable regulation.
  • Attempt to gain unauthorized access to our systems, accounts, or infrastructure.
  • Transmit malicious code, spam, or automated requests that place unreasonable load on our systems.
  • Scrape, harvest, or systematically extract data from the Services without our written authorization.
  • Misrepresent your identity or affiliation when using the Services.
  • Interfere with other users access to or enjoyment of the Services.

We reserve the right to investigate suspected violations and take appropriate action, including suspension or termination of access.


9. Third-Party Content and Links

The Services may contain links to third-party websites or reference third-party products. Such links do not constitute an endorsement by Dermalapps. We are not responsible for the content, accuracy, or practices of third-party sites, and you access them at your own risk.

The Services may display or recommend third-party skincare products. We do not specifically endorse any particular product or brand. Any affiliate relationships that influence product placement or recommendations will be disclosed where required by applicable law.


10. Disclaimer of Warranties

Please read this section carefully.

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Dermalapps disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • DSI values, forecasts, or sensor data will be accurate, complete, or error-free.
  • The Services will be uninterrupted, timely, or free from technical errors.
  • Skincare guidance will produce a specific result for any individual.
  • The Services will meet your specific requirements.

Environmental modeling involves inherent uncertainty. DSI values are estimates derived from weather data and standard indoor assumptions; actual conditions in your home may differ.


11. Limitation of Liability

Please read this section carefully.

To the fullest extent permitted by applicable law, Dermalapps and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, lost profits, personal injury, or property damage — arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow exclusion of consequential damages, our liability is limited to the maximum extent permitted. In all cases, our aggregate liability to you for any claims arising from the Services will not exceed the greater of (a) the total fees you paid to Dermalapps in the 12 months preceding the claim or (b) $50 USD.


12. Indemnification

You agree to defend, indemnify, and hold harmless Dermalapps and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right, including intellectual property or privacy rights.


13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions.

Informal resolution. Before initiating any formal proceeding, you agree to contact us at support@dermidia.com and give us 30 days to attempt informal resolution of your concern.

Binding arbitration. If informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Dermalapps each waive the right to a jury trial and the right to participate in a class action or class arbitration. You may opt out of this arbitration provision by notifying us in writing within 30 days of first agreeing to these Terms.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent misuse of intellectual property or unauthorized access to the Services.


14. Termination

You may stop using the Services at any time. To close your Dermidia Sense account and request deletion of your personal data, contact us at support@dermidia.com.

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice. Provisions that by their nature should survive termination (including Sections 7, 10, 11, 12, and 13) will do so.


15. General Provisions

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Dermalapps regarding the Services and supersede any prior agreements.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
  • Waiver. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
  • Assignment. You may not assign your rights or obligations under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
  • No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Dermalapps.
